The WTC Cross: Why The Lawsuit Needed To Be Filed

The United States National Church  - Think It Can’t Happen?

“It is proper to take alarm at the first experiment on our liberties. We hold this prudent jealousy to be the first duty of Citizens, and one of the noblest characteristics of the late Revolution. The free men of America did not wait till usurped power had strengthened itself by exercise, and entangled the question in precedents. They saw all the consequences in the principle, and they avoided the consequences by denying the principle. We revere this lesson too much soon to forget it. Who does not see that the same authority which can establish Christianity, in exclusion of all other Religions, may establish with the same ease any particular sect of Christians, in exclusion of all other Sects? that the same authority which can force a citizen to contribute three pence only of his property for the support of any one establishment, may force him to conform to any other establishment in all cases whatsoever?” – President James Madison, Memorial and Remonstrance Against Religious Assessments (1785)

If there ever was a statement that enshrined the spirit of the First Amendment’s Separation of Church and State clause, this is it.  President Madison was addressing a bill that was presented in the last Session of the General Assembly, titled “A Bill establishing a provision for Teachers of the Christian Religion.”  Madison believed that if any religion were given special provision under the law it would be a “dangerous abuse of power.”

That Old Rugged Cross

There are Atheists who are falling in with those who are against the American Atheists, Inc. lawsuit regarding the World Trade Center Cross.  The suit has been called everything from frivolous to petty. They also believe we are fighting against religion, which is causing us to appear as fundamentalist as the most rabid believer.

However, the suit is not about fighting religion, it is about the setting one precedent to avoid a plethora of others.  It is just as important as the 1963 case that made prayer in public schools illegal.  This case is about equality in a diverse national community.  It is about the protection of the rights and freedoms of not just Atheists, but of all citizens, even those who belong to the “wrong sect” of Christianity. It is about the preservation of the very principles that Madison wrote about and that many of our Founding Fathers had put forth in the drafting of our secular constitution.

The suit to remove prayer from public schools back in 1963 was also met with harsh criticism and much resistance from the Atheist camp, and some of the same questions were raised as are being raised now by Atheists who disagree with our decision to sue. But, in retrospect, we all can agree that the School Prayer case was one of the most important First Amendment cases to be won, and when we win this suit, the consensus will be the same, in time.

In 1963, there were many Atheists who didn’t understand what harm it would cause to let the Christians have their prayers. They said we should just ignore it and choose not to participate. We can see where that would have ended up.  Likewise, when Atheists today ask what harm does it to do let them have their monument; just ignore it, that would set a far-reaching precedent in First Amendment law.

Precedents

Indeed, Representative Michael G. Grimm (R-NY) is planning on introducing legislation titled “The 9/11 Memorial Cross National Monument Establishment Act of 2011.” The purpose of this bill would establish the 9/11 Memorial Cross as a national monument. His argument is that, “This cross was a symbol of hope and freedom at a time when New Yorkers were coping with loss and destruction in the aftermath of the deadliest terrorist attack on American soil… …By establishing the 9/11 Memorial Cross as a national monument, we ensure this symbol of freedom continues to stand for all those we lost and those whose faith remains to this day.”

That is fine and dandy if you are a Christian, but I was raised in New York City and lived there for decades and I can tell you with great certainty that not all New Yorkers are Christian.  I have a feeling that goes for the entirety of the United States Citizenry.  There are many who do not view the cross as a symbol of freedom. While many may be indifferent about it, there are those for whom the cross depicts credulous servility that represents bigotry, hatred and discrimination.  It is a poor choice for a national monument because it not only takes the attention away from the victims and puts it on the church, but it also implies (according to Christian doctrine) that the victims in those terrorist attacks who were not Christian are currently burning in hell.

As if being burned alive by jet fuel wasn’t enough.  That, alone, makes the Cross totally inappropriate.  But it is more than inappropriate.  It is illegal.

A Turn Of Events

As far as the lawsuit goes, while it was initially filed in the state courts of New York, it has since been removed to the Federal Court.  American Atheists, Inc. National Legal Director Edwin Kagin states, “A case that has both federal and state issues can be ruled upon by a judge in a State court, but if the defendants want it moved to Federal court, they have that option

This is exactly what they did, and according to law, it cannot be undone.  Their reasoning behind this was that they felt the judges in liberal New York would not rule favorably to them.  However, one does not get to pick which judge will be hearing the case in Federal Court, and this has worked to our advantage.

The judge who drew the case is none other than Justice Deborah A. Batts.  Judge Batts has degrees from both Radcliffe College and Harvard University, was an Assistant US Attorney, an Associate Professor of Law at Fordham University, the Special Associate Counsel to the Department of Investigation for New York City and was appointed on the recommendation of Senator Daniel Patrick Moynihan, was appointed by President Bill Clinton to a seat on the Southern District Federal Court.

Judge Batts is also an African American Lesbian.  So much for Divine Providence…

It cannot be stated emphatically enough that American Atheists, Inc., is not “suing religion” and are we not fighting against any individuals right to pray to who or whatever they want.  We are fighting for the preservation of the United States Constitution and for the equality of all American Citizens.

Keep evangelism and politics out of US Military funerals

Thursday, September 8th, 2011

A few weeks ago, I wrote about the fabrication of a controversy surrounding military funerals for veterans in Texas (my home state). Three Congressmen from Texas are in the middle of a deceptive media blitz.

They are ‘standing up for’ a few private groups who like to officially incorporate their Christian prayer and ceremonies at the funerals of military veterans. The problem is, well… there is no problem!

There is no ban of mentioning ‘God’ or ‘Jesus’ at funerals for veterans. These outside organizations simply need to ensure that their religious message is actually wanted by the grieving family. But that’s not good enough for them, they want to be entitled to religious ceremony at every funeral by default sans any form of permission.

They literally want to force Christian prayer over my dead body. But even that’s not good enough, they are now going for the jugular.

These groups aren’t being discriminated against in the slightest, they just need to get a form signed. When the Houston National Cemetery director Arleen Ocasio pointed to this fact, the Texas politicians and religious zealots made it their personal mission to get her fired.

The American Family Association (AFA) has issued a deceptive action alert to their members.

VA Bans Mention of God at Funerals for Vets

Send an email to U.S. Department of Veterans Affairs Secretary Eric Shinseki. Ask him to

1) stop his department’s religious discrimination and

2) relieve Director Ocasio of her duties.

Counter the AFA’s publicity stunt before those dangerous TX politicians start drafting laws around this falsehood. Also, let’s attempt to save this poor woman’s job.

With just 1 minute of your time, you can help us debunk the propaganda and lies about “god” and “jesus” being banned from funerals. This is 100% false, and the zealots are winning the PR game. In my capacity as the Military Director for American Atheists, I’m going to fight this insanity. Here’s an easy way that you can help.

Have 1 minute to help? Click here to send a message to the Dept. of Veterans Affairs

If you are unfamiliar with the statements being made by the Texas politicians, I’m re-posting the handy scorecard below the fold.

9/11 Cross Activism for Everyone!

Thursday, September 8th, 2011

American Atheist Supporters:

This is the week to let the 9/11 Memorial Foundation and our elected legislators know that we want an inclusive memorial for ALL Americans who were the victims of the 9/11 attacks, not just the Christian ones!

Direct your contact to http://911MemorialCross.blogspot.com. This website contains all of the factual information and arguments as to why we should have an inclusive memorial, and why the insertion of the 10-ton, 20-foot-high “girder cross” is grossly insensitive for non-Christian Americans.

For those who use Twitter, please include the above URL with the Twitter tags #911memorial and #911MemCross. Feel free to use any of the Talking (Twitter) Points from the above campaign website. And follow @AAtheists for ongoing campaign Twitters from American Atheists. Also follow the Official American Atheists on Twitter @americanatheist.

We have set up two on-line petition sites for supporters to use to communicate to the 9/11 Memorial Foundation and to our NY and US legislators and executives. Supporters can choose which message works better for them:

* Remove the Christian Cross from the 9/11 Memorial

* Ensure Equal Representation for All 9/11 Attack Victims

We have set up a specific campaign schedule on the AA 9/11 Memorial Cross website to maximize our impact and message. Please check the schedule for actions to take each day this week.

START TODAY by using the above petition website to let the 9/11 Memorial Foundation know your position on their actions. We’ll have a different target constituency for you to reach every day this week.

We will be sending out daily reminders of this campaign all week. Please forward this information to your lists and contacts!

Thanks for your support!

Most Of The Religious Right Are Not Stupid, Just Willfully Ignorant

Tuesday, September 6th, 2011

Michele Bachmann, Sarah Palin, Glenn Beck, Rush Limbaugh, Rick Perry, Mitt Romney, Ron Paul, Tim Pawlenty, George Bush and many other well-known politicians who are also members of the religious right are often branded as “stupid.” This is largely due to their irrational beliefs such as God watching over us, Jesus answering prayers, the earth having been created in six days approximately six thousand years ago and a plethora of other supernatural silliness. However, most of these people are not stupid, per se. They are willfully ignorant, and unlike those of us who have managed to escape the shackles of religious belief, these people continue their progressively fundamental indoctrination as it slowly erodes their sense of what is real until their delusion results in the dismissal of some very important facts in favor of fantasy.

The proliferation and public acceptance of willful ignorance is evident when we realize there are millions of history revisionists and creationists among us, many of who hold graduate and post-graduate degrees and occupy high-ranking positions in academia and the political arena. As Atheists, many of us are inundated with a flurry of irrational and illogical statements made by our current crop of celebrity fundamental Christian politicians and educators.  We are also aware that there are literally millions of lesser known but equally educated people (and voters) who also believe in creationism and that the United States is a Christian Nation founded on Biblical principles. This is in spite of the existence of historical documents in our national archives that attest to the secularism of our Constitution and founding principles, as well as the veritable cornucopia of facts that make up evolutionary theory.

Likewise, even though there are hundreds of religions in the world, many of which both mimic and pre-date Christianity, believers remain convinced that Christianity is unique among world religions because their savior was born of a virgin, was crucified, arose in three days and that Christianity is the only true “religion” in world, extant since the beginning of time by virtue of another preposterous fairy tale known as “the Trinity.” They are, effectively, trying to  “dumb-down” the United States.

They hold these irrational and illogical beliefs because they have been indoctrinated through various evangelical formulae. These beliefs subsequently become the foundation for their worldviews, which allow them to exist simultaneously in both a fantasy world and reality.  Consequently, we have willfully ignorant school teachers who refuse to teach evolution, willfully ignorant businesses professionals that regularly intrude on the private lives of their employees by forcing as a condition of employment to sign documents that regulate their behavior outside of the workplace, willfully ignorant politicians who organize prayer rallies and regularly ask their constituents to pray for rain, and willfully ignorant legislators who spend the majority of their career trying to enact laws that interfere with everything from what goes into textbooks, what a woman can and cannot do with her body and the official government recognition of sectarian beliefs and monuments.

However, basing one’s concept of reality on fantasy and fairy tales is an unstable existence, requiring “work-arounds” that baffle the mind. The mental gymnastics that it takes to reconcile religious beliefs with the facts of life are often unreachable, and much like the bad apple that spoils the bushel, it is the fantasy world that usually corrupts reality and results in the mental destruction of the human mind.

Thus, the birth of “superfundies.” The activities of these few, spurred on and supported by the less educated but more abundant indoctrinated masses are what generates all the lawsuits that are filed to challenge the abrogation of the civil rights of those who lack a belief in God and find the morality associated with religious belief to be immoral and reprehensible.

Ultimately, it is the mind that defines our species.  The ability to discern fact from fiction is what advances our society.  Religious indoctrination of our educators, legislators and political leaders only serve to dilute our collective evolution as a species, stymie our collective intellectual growth and come at a great cost to our mental and physical of existence, especially in the realm of education and politics.

Millions of taxpayer dollars used to convert soldiers and their children to Christianity

Sunday, September 4th, 2011

BY JUSTIN GRIFFITH, ON SEPTEMBER 3RD, 2011

(Justin Griffith is American Atheists’ Military Director. Posted to the NoGodBlog by VP Kathleen Johnson)

Chris Rodda wrote an extensive exposé on the amount of your taxpayer money being spent on converting soldiers and their children to Christianity.

Your money.

  • The Soldier Fitness Tracker that includes the mandatory Spiritual Fitness testing and the equally mandatory remedial training.
    $125,000,000
  • The Spiritual Fitness Center at Fort Hood, Texas (many more to come!) – Often described as a ‘mega church’, the building even has religious stained glass windows. They are stocked with video games, phone cards, and other incentives. Packaged with a religious message. This is in addition to the numerous chapels on every post.
    $30,000,000
  • Spiritual Fitness concert series at Fort Lee and Fort Eustis - Invariably evangelical Christian messages and performers. You’re on notice for a future Rock Beyond Belief event, by the way.
    $678,470 (performer fees only)
  • Strong Bonds and other Spiritual Fitness Retreats – These are marriage counseling seminars held at luxurious vacation spots. Notoriously stuffed to the brim with evangelical messages. There are ‘sue-proof’ teaching materials that are often offered up as a defense, but it’s a shallow ruse. When I went to one I literally counted 57 instances where I was offended by the overt religiosity (“The family that prays together stays together…” “Bless this lunch break, oh heavenly father” etc…)
    *$30,000,000  (*Annually)
  • Williamsburg Christian Retreat Center – hosting Spiritual Fitness retreats
    $120,000
  • Peninsula Baptist Association’s Eastover Retreat Center – hosting Spiritual Fitness retreats
    $75,000
  • American Baptist Church Conf. Center – hosting Spiritual Fitness retreats
    $53,000
  • Quail Ministries – Christian music and comedy during Strong Bonds marriage counseling retreats. Like those awful variety-show acts you sit through during a cheesy school assembly.
    $84,000
  • “Serving Christ Through Baseball” program – entertainment during Strong Bonds marriage counseling retreats. Title says it all… or not. I’m still scratching my head on that one.
    $80,000
  • Military Community Youth Ministries – evangelism targeted at children (even stalking them on their way to the school bus)
    $12,346,333
  • Cadence International – aimed at converting children to Christ, as well as citizens of foreign countries in the nations that they operate in.
    $2,671,603

Keep in mind that it is entirely outside of the scope of the Chaplaincy and the DoD’s other religious support to convert new people to a particular faith. They are certainly expected to tend to their ‘flock’, but not to grow it.

Is it evangelism? (yes)

Sometimes outsiders may not understand the smokescreen from terms like “Spiritual Fitness”. Some people might not recognize the evangelical creep from a cursory glance. Even a (very) small number of atheists have written to tell me that they had no problem with the questions on the Spiritual Fitness test.

They buy the claim that “Spiritual Fitness = Team Spirit” Or they claim to have no problem being “Spiritual Atheists” (focusing on the beauty of the universe, music, art, etc…) These justifications fail hard when faced with the reality of the situation we foxhole atheists face. These rationalizations are not consistent with the over-the-top “get right with god so you don’t kill yourself” message that was intended all along.

Here is a sample from the mandatory remedial Spiritual Fitness training after you fail the test.

Still not convinced?

How about reading this chilling account of a Christian soldier who was forced to go to his Chaplain “to get born again” after his spiritual fitness failure on the same test.

My education, health, salary, and pension are shrinking… How about we lose all of this Spiritual Fitness stuff instead?

In a time when national debt is relatively common discussion, it seems that unconstitutional spending of hundreds of millions of dollars would be a natural choice for the chopping block. Instead, my educational opportunities (eArmyU), yearly salary increase for inflation (lowest in 50 years), retirement benefits (pensions for 20+ year veterans are now considered ‘on the table’ to be cut), are already in place or soon to be.

Insanity. How is this not shocking people? Being at the receiving end of a lot of this proselytism, I’m telling you that the system is broken. We need help. We need you to care.

Chris Rodda is a long time supporter of Rock Beyond Belief. She is the author of the eyeopeningLiars For Jesus (a book she has now given away for free). She now works at the Military Religious Freedom Foundation as head of research. MRFF are co-clients with me in pending litigation against the mandatory Spiritual Fitness testing and training.
