Sorry, You can’t sue what doesn’t exist.

Thanks to EVERYONE who sent this story in!

Legal case against God dismissedGod on a cloud in a 18th century depictionThe plaintiff argued an omniscient God would know of the lawsuitA US judge has thrown out a case against God, ruling that because the defendant has no address, legal papers cannot be served. The suit against God was launched by Nebraska state senator Ernie Chambers, who said he might appeal the ruling. He sought a permanent injunction to prevent the “death, destruction and terrorisation” caused by God.Judge Marlon Polk said in his ruling that a plaintiff must have access to the defendant for a case to proceed.”Given that this court finds that there can never be service effectuated on the named defendant this action will be dismissed with prejudice,” Judge Polk wrote in his ruling.Mr Chambers cannot refile the suit but may appeal.’God knows everything’Mr Chambers sued God last year. He said God had threatened him and the people of Nebraska and had inflicted “widespread death, destruction and terrorisation of millions upon millions of the Earth’s inhabitants”.He said he would carefully consider Judge Polk’s ruling before deciding whether to appeal. The court, Mr Chambers said, had acknowledged the existence of God and “a consequence of that acknowledgement is a recognition of God’s omniscience”.”Since God knows everything,” he reasoned, “God has notice of this lawsuit.”Mr Chambers, a state senator for 38 years, said he filed the suit to make the point that “anyone can sue anyone else, even God”.

“Chambers, who has served a record 38 years in the Nebraska Legislature, is not returning next year because of term limits. He skips morning prayers during the legislative session and often criticizes Christians.”
Sounds like a man after my own heart!!

so why didn’t he put the vatican as the primary address of god? i mean, they claim to have a direct line to the figment… so they should be able to at least let him know he has a court date coming up.

i’m surprised that prayer didn’t work. lol

So, if one has no address, one can’t be sued? Or otherwise prosecuted in court? Hmmmmmmm. Let me file that away for future reference, in case I’m ever homeless and decide to call myself God and go on a killing spree.

I think da judge needs to come up with a better excuse.

  4. DVanWechel says:

It’s funny, this Judge sooooooooo didn’t want to touch this can of worms.

I’d love to dress up in a sheriff’s deputy uniform and go to a church and ask the pator/priest if God is there. He would most likely say, “Of course.”

I’d say, “Well, could you get him for me please? I need to serve him a summons.”

I would have loved to issue a victim’s statement and the sentencing hearing.

  7. fosters24 says:

It would have been sweet if the judge fined God for contempt of court for failing to appear. Or better yet issued a bench warrant. It’s an all points bulletin to arrest god.

  8. charlie says:

is it possible the judge does not believe there is a supernatural being….and picked an easy way out citing no address for the lord…

if the lord had an address….I’d expect the zip code to be outside the boundaries of the universe…..universe including heaven and hell of course…..

This not related but interesting is

    http://news.yahoo.com/s/politico/20081016/pl_politico/14641

McCain is trying to connect Obama with voter fraud…..the only problem with that is that we havnt voted yet….

  12. quantum_flux says:

Obama is participating in pre-meditated voter fraud, but that’s okay because the electoral college will more than compensate for this “mistake”.

  13. reason says:

Regarding the point Chambers was trying to make.Should you be able to sue anyone you want?

  14. what says:

    Yes.

  15. charlie says:

so Im watching McCain and Obama speak at some casual event…and after hearing them both speak it seems as though they had the same speech comedy writer wanna bee…..

  16. TXatheist says:

I don’t know about this. When a homeless guy, VanOrten(sp) sued TX for the 10 C monument he was allowed to. Or is it only the one being sued that has to have a home.

  17. DVanWechel says:

Knowing very little about law, I would guess that when one brings a lawsuit against a specific entity, I would assume the entity (whatever, or whomever it is) must be shown to exist in some demonstrable manner.

    Unbelievable isn’t it?

Just a quick comment on the previous post about Palin,
as Canadians we have always viewed Americans to be extremely religious & conservative. Well the joke is on us as we just finished re-electing the very same extremely religious party in Canada.
    Sad isn’t it?
