American Atheists Legal Director has filed suit on behalf of his client to appeal a recent ruling allowing his client’s born-again Catholic wife to place his child in a Catholic School instead of public school against his will. The opposite would not be true in a converse situation. If the parent sent the kid to public school, the child would not be taught anything bad about Catholics.

“Born-again” is a phrase used almost exclusively by Evangelical Protestants. Catholics and Protestants take such distinctions very seriously. Millions of them have died in wars over how exactly to worship.
Also, it might help to place “against his will” in a different spot. As it reads now, it sounds like the kid does not want to go to the public school. Doesn’t sound like that’s what was intended.

I have no problem with born-again catholic. It implies a fundamentalist belief system to me; as well as an insult to the ?born-again?s? mother since she evidently didn?t get it right the first time.
Back on subject, tradition and the courts have long favored mothers in any parental rights issue. There has been some movement away from this but it?s spotty and slow. Logic would dictate a public or other secular school as the appropriate compromise. But as all atheists know, being able to apply logic to an issue is also spotty.
I say send the kid to Catholic School. That’s the surest way to make the child loathe Catholics.
Its my understanding that in many states, divorce jurisprudence is totally a creature of statute, created and governed by the legislature.
Speaking from experience, I myself had an issue that I appealed. The State Supreme court took it from the Appellate court’s “in” basket, thus not allowing the Appellate court to rule, so they could shape the the law as the states all mighty body.
In the PDF, the brief says the kid is 14. He is at the age where the trial court / family relations will tend to listen with greater interest and hold his opinions with higher regard to an issue before it.
Ya want to see “reality”… Stop giving $$ to the laywers and get more “Big Bang” for the buck:-) by buying the kid’s wants and interest. Depending on the desire of the non-custodial dad, there are a couple things I would recommend, with what I know.
Though it will take away from fun times together, the dad while in physical custody of his Son, could lovingly explain the issue. His Son, at 14 is not so naive as one may presume. I myself believe there is primarily peer pressure at work here as well as the noted environmental factors at his custodial residence.
If the court is found to have erred in its discretion / jurisdiction, I see it being sent back to the lower court to rule on it properly, albeit with the same outcome. I viewed no financial evidence presented with regard to the child’s support as it may relates to the school and or may not relate to this private school. As well as his attendance in such an learning environment being an unprecedented application up until a couple years ago… I could go on but to be frank I’ll just say, “Dad” Buy him an Xbox 360, Plasma TV, let him stay up late, have friends over, thats it, buy him some friends, get him a speed boat, Dirt bike, you get the idea. Petition the court for physical custody, “Bam”. I myself could not afford all that crap, but I’ve seen it work… One of the best ways to learn is by making mistakes, some would argue its the only way to learn? Money talks and very often allegiance will walk. I’d say let it go if you love your Son. Don’t support the the legal industry, now is not the time as it relates too this issue. “especially in KY :-O Its a fact the child is now going to be exposed to both view(s)from now until one of the two parties change their views. I forgot to mention. My two children now live with me and have learned to think for themselves. They are respectful to others and at the same time do not take there marching orders from 1 book.
According to proponents of voucher schemes, any religious school would be eligible for cash at taxpayer expense. That said, the vast majority would be xian, which is why evangelical xians are the big supporters. There have been several posts on this blog about vouchers, none of them blind to the fact that this is a money grab by the churches, who run their lucrative child indoctrination businesses as “charities” and pay no taxes. Now they want to consume taxes too!

Although I have been an atheist my entire life I was raised in a catholic family and was baptized and confirmed – amazing what kids will do to please their parents or keep the peace. I never once heard anybody sincerely claim to be a “born again catholic”. Have you ever heard some sincerely claim to be a born again jew?

Me and my circle of friends have been talking plenty about the 200 “teenagers” (the local media refuses to report that they were all black although they now are posting the pics of those arrested) that aped out at Triangle Town Center mall in Raleigh and caused a violent riot. Hey at least it didnt happen in Durham! However my car window was broken last week by two black thugs who stole my GPS and satellite radio while I was parked at Target. I have the police report right here if anyone wants to see it. Is it any wonder I feel the way I do about blacks?
