I can't imagine choosing a theist as a life partner. How can you be a team if you don't share a common perception of the one most important thing in life - our very perception of existence itself?

my first instinct is to let the kid decide, since his parents aren't in agreement.

his parents really shouldn't be playing tug-o-war over him.

Since both schools are considered to be academically equivalent I think the kid should have the say where he goes which, in this case, is the catholic school.
I'm sure the courts will rule in favour of the mother since the US court sytem is very prejudiced against father's rights.
This is the link to the article sourced in the blog entry:

http://www.courier-journal.com/apps/pbcs.dll/article?AID=/20080406/NEWS01/804060502&referrer=FRONTPAGECAROUSEL

I have one objection to Stenger's (a law professor) statement:

"If the father were to win, it would put the authority of the court against religion, which both the federal and state constitution forbid," Stenger said.

"It could be called establishing atheism."

No, it would not be establishing atheism. It would be establishing neutrality on the issue. If the father was Protestant, and all other facts remained the same, then by forcing a public school, would the court be establishing Protestantism?

---

Anyways, I think the student's choice trumps the parents' choice in this case. If this were a custody hearing, the court would likely let the teenager decide which parent had primary custody. If so, he should be able to pick his own school.

However, why did the court choose the religious school when the kid was younger? Minus extraneous factors, should the "neutral" school be the choice?
you're right. they should be able to ignore the religious affiliation or lack thereof of each school when ruling on this case.

but you know they wont. =/

it doesn't really matter in this case because the kids a teenager and should be able to decide for himself which school he wants to attend, but in future cases they should be able to ignore which parent wants the kid to go to which school, and base the determination on only two things: 1) is one school plainly superior in its academics 2)is there reason one parent's preference should trump the other's. (for instance, if one parent is estranged and has not been involved in raising the child up to this point)
also, you'll notice that Stenger hasn't complained that giving the authority of the court to the mother would be establishing catholocism.

It's not so hard if your wife is "spiritual" and never says god created everything. Yes, we had the discussion on one of our first dates. I plan to explain to my kids what many faiths believe but I plan to explain it as a "belief" and god is an idea.
